A deal to offer Hungarian Prime Minister Viktor Orb\u00e1n EU funds as part of a deal over support for Ukraine was slammed by the bloc\u2019s budget watchdog in a report released today (22 February). Brussels should enforce the rule of law based on sound analysis, not political horse-trading, the European Court of Auditors (ECA) said.<\/p>\n<p>The European Commission has long had significant concerns over judicial independence in Poland and Hungary, but new rules it has introduced are far from watertight and prone to box-ticking, the report said. \u201cThe rule of law is one of the fundamental values of the EU,\u201d ECA member Annemie Turtelboom told reporters, adding that the \u201csituation in some member states has clearly deteriorated&#8221; over recent decades. \u201cNew safeguards are really a commendable step forward\u201d from previous lumbering procedures, but \u201cthere are chinks in the armour\u201d, Turtelboom said, calling for greater transparency and solid evidence.<\/p>\n<p>Turtelboom cited last December\u2019s European Council meeting in which Hungarian leader Viktor Orb\u00e1n apparently agreed to relinquish his veto on funding for Ukraine in exchange for \u20ac10bn of EU cash. \u201cRule of law related decisions must be grounded in technical and legal analysis, however political considerations may ultimately play a major role,\u201d Turtelboom said. \u201cWe saw this happening on 13 December.\u201d<\/p>\n<p>\u201cWe cannot afford a box-ticking exercise that only embellishes the situation on paper,\u201d she added, noting that Hungary\u2019s new Integrity Authority, whose creation was a condition for the release of funds, was no guarantee of sound spending \u2013 not least as Budapest could disband it with few consequences. Concerned over breaches to the rule of law in Hungary and Poland, Brussels has withheld funds worth \u20ac22bn and \u20ac134bn respectively, the ECA found.<\/p>\n<p>But despite the eye-catching figures, \u201cthe immediate impact is actually quite limited,\u201d Turtelboom said, as the law applies only to future financing, and does not impact farm subsidies. \u201cOne third of the European budget, the Common Agricultural Policy, is at this moment not affected by these measures,\u201d she said. \u201cWhether it should \u2013 that&#8217;s a political decision, up to the commission, the parliament, and the council to decide.\u201d<\/p>\n<p><em>Brussels releases \u20ac10 billion in frozen EU funds for Hungary amid Orb\u00e1n&#8217;s threats<\/em><br \/>\nIn a statement sent to Euronews, a commission spokesperson denied there\u2019d been blackmail by Hungary in relation to the December decision. \u201cWe are applying the rule of law,\u201d the spokesperson said, adding that funds had been unblocked as Hungary fulfilled legal conditions. \u201cThe commission disagrees with the ECA\u2019s description that this is a \u2018box-ticking\u2019 exercise,\u201d the spokesperson said. \u201cFor all remedial measures, the Commission monitors their concrete application and effectiveness.\u201d<\/p>\n<p>Two weeks ago, the commission issued legal action against Orb\u00e1n\u2019s government for its \u201csovereignty law\u201d, which empowers the Hungarian state and secret service to probe any group seeking to influence domestic politics.
